Marianna C. Pontoriero, Esq. is certified by the New Jersey Supreme Court as a qualified mediator. In some instances, mediation may be the best answer.
Marianna C. Pontoriero, Esq. has also served as a Guardian Ad Litem in the Court system. This title is given to a person who is appointed by the Court system as guardian for an infant, young child, and/or other person who may not be capable of representing themselves. This ‘guardian’ will act on his or her behalf in a particular action of proceeding.
There may be specific times in a divorce litigation that children will need to have a voice of their own. Sometimes in a divorce proceeding, custody arrangements may be the most difficult issue to resolve. Unfortunately some parents choose to put their children in the middle of the litigation. It is times like these when a child may need to have “a voice of their own” through an attorney or someone who can project their feelings and opinions to the Court system.
The Court uses statutory factors when determining custody issues in a case. Although these factors are not the only part that is used to determine custody, they are often used as a starting place.
Some of these factors include: the ability of a parent to care for the child, the willingness of a parent to accept custody, the parents’ willingness and ability to cooperate and communicate in matters that relate to the child, the safety of the child, home environment, age of child, quality of time that the parent can and will spend with the child, etc.
